买房其间遇到的棘手问题.

各位朋友本人在买房中遇到非常棘手的事情,请帮忙出出主意.三星期前我们看中了一个独立房,放了两万押金.第二天验房后,发现房子有结构等问题不能接受,所以就决定不买了.但直到今天我们押金还拿不回来.因为加法律规定,拿回押金必须四方(买方,买方经纪,卖方,卖方经纪)签 mutual release,即使offer无效 也必须签字才能拿出.现在卖方就是不签字,我们也不清楚他不签的意图.因为卖方的经纪做了几次工作,没做通,就不管了,说交给她老板.现在我们一直都在和双方经纪联系,但没什么进展.当然了钱不是从他们口袋里掏出的,他们不会和我们一样的心情.请问有没有哪位朋友遇到类似问题或听说此事,帮忙拿拿主意.恼谢谢了

    • 钱应该不是在卖主手上,而是在卖方经纪手上。但是卖主不签字,经济不能还你。不过卖主不放手就不能接别人的奥佛。

        • conditional or firmed offer?
      • this should not be conditioned upon the signature of seller, as long as you do not want to buy, you should be able to get the money back, your agent should have the responsibility to help you on this.
        • it's condition offer with house inspection. Right now, my agent never to call me first. i have to push her and her company to find out the solution.
    • 你是不是下了无条件的Offer啊?
      • We have cancelled financial condition but have kept house inspection condition which caused problem.
        • 你不签Waiver,合同不生效,对方怎么可能扣钱呢?
          • My agent said it's canadian law that only deposit ( In trust account in seller's company, broker has been signed by four sides, the money can be returned to buyer. Nothing to do with the offer (contract). That's also puzzling me up to today.
