New tenancy
(3) Despite subsections (1) and (2), if the landlord enters into a new tenancy agreement with a new tenant with respect to the rental unit, the tenant who abandoned or vacated the rental unit is not liable to pay an amount of arrears of rent that exceeds the lesser of the following amounts:

1.�The amount of arrears of rent determined under subsection (1) or (2).

2.�The amount of arrears of rent owing for the period that ends on the date the new tenant is entitled to occupy the rental unit.

    一年半以前,也就是08年12月底,我们从一个appartment里面搬出来。可是前不久收到房东的一封信,告知我们需要再补交一个月的房租,我们是08年11月初通知房东我们要搬家,在08年12月底将钥匙还到管理处,可是这封信却让我们补交1月份的房租,理由是我们需要提前60天通知管理处,但是由于我们晚通知了一个星期,所有搬走后的一个月的房租仍然由我们负担。不知道有没有人遇到过这种情况,从法律上而言应该怎么处理。
    • 一般的规定是,必须提前60天通知。如果不满60天,顺延到下一个月。所以,你应该交到一月份。
    • 看你们当初签的合同和你所在的州/省有关规定。一般讲,是要按照合同执行,有的州/省规定违背本州/省法律的合同不合法。如果没有合同,安省landlord tenant act规定也是60天。那你们肯定要付这一个月钱的。
    • 你可以去敲门,问下现在的房客是几月份入住的,如果是2月份入住的,那1月份的房租很不幸的要由你们承担。不想交的话,也可以搬家,就当没收到过信,不过你的信誉分有可能被破坏。
      • 下一个租客何时入住和楼主没关系。楼主违约在先,要承担合同中的惩罚条款之规定。例如,房子空了三个月,楼主都要交三个月的钱。本案中,最好的办法是先和管理处沟通,争取少交点。切不可不予理睬。
        • 你说不对,跟下一个住户有关系,,其是我不知道你的情况,但是一点肯定他们会找你麻烦,但你有没有他们叫你搬家的通知, 不用理他,没是的

              • Great guy and great point. In this case, both legal parties are LZ and apartment, nobody else. Though new tenant's move in may does LZ a favor(if you have evidence), the legal parties are LZ and apartment.

                    • 这个理儿得这么看,有人能到买个物美价廉的二手私售车,有人能花个大价钱买个回家就不能动的车。所以就要根据个人情况而定,是买私人二手车,还是到个大的好的dealer
                      那里买个放心点的二手车。依人而定。

                      你朋友的事情和楼主的事情,就事情本身来说不同之处在于:你朋友的事情,去转接的时候,属于事情未决状态,何况无凭无据;楼主这里是白纸黑字阶段。

                      遇到的有的比这个额度大很多。最重要的不是遇到过、听说过,而是于法于理都通,并从经济和精力的角度都要可行。

                      其实我们都是给楼主好心提合法合理的建议,最终还是要楼主结合自己实际情况甄选而定的。

        • 1) even empty 3 months after her leave, lz just need to pay 1 month empty since she give more than 1 month notice. 2) if a new tenant move immediate after lz leave, lz do not need to pay anthing.

(1) If a tenant abandons or vacates a rental unit without giving notice of termination in accordance with this Act and no agreement to terminate has been made or the landlord has not given notice to terminate the tenancy, a determination of the amount of arrears of rent owing by the tenant shall be made in accordance with the following rules:

    • 管理处在你们走时为什么没有提出这个要求?好像这种事有个期限吧,过期作废,你自己查查租房的有关规定,如果有纠纷一年内不追究自动作废这条,你就不用付了
