枫下茶话 / 法律 / 有谁知道如何申请政府赔偿程序的呀。去年我让人给污告了，当然是属于刑事（如果证明我有罪的话），直到今年3月底警方才撤诉。我现在想申请政府赔偿，如果成功，我还准备起诉那个日本人，告他诬陷我

不太明白，政府需要赔偿你吗?政府没有判你有罪，接到举报，立案调查是正常的吧？应该找的诬告你的那个人。

这是日本人报的警，所以警方根据这个证人就起诉我，所以我的思绪是警方是错误的，因为没有明显的证据就起诉，必然会给对方告诉伤害。
另外，如果我获得政府赔偿，这个日本人就死定了，因为我有两个证据来说明这个日本人是成心来污告别人的。

不十分清楚你的情况，一般来说警方接到报案都会调查，如调查后觉得证据不足，当然不会起诉，但警方不可能不调查。既然警方已经决定不起诉，你完全有足够的理由告那个日本人诬告。告警察好像理由不充分。这么专业的问题应当咨询律师。

你不把事情说清楚，没人能帮你。政府赔偿是拿不到的，我看来没有人做错什么。那个日本人估计你也拿他没办法。

Can you more specify what is 撤诉? If it does mean the withdraw after proceeding, it means you had been arrested. In this sense, you can claim the compensation.I can not see you are able to directly sue that Japenses because the matter is of the nature criminal law. If that Japenses did perjury and was the sued from the Crown, yes, you may start your civil compensation claim based on that. If he/she was not sued from the Crown, it is likely you won't be able to establish how his/her behaviour caused your suffering.
If you were never arrested, you can claim nothing, frankly.

好像很难，记得杜克大学的那个强奸案吧，当初又是游行又是抗议的，后来查来查去是那个丫头诬告一群人强奸她，最后也没啥事。记得法官说有很可能记错了，后来就这么结了。
